Consultation on updated guidance on preventing sexual harassment at work

Yesterday,  the Equality and Human Rights Commission (EHRC) launched a consultation on an update to the technical guidance for preventing workplace sexual harassment.

This very long awaited update is necessary to implement the changes to the Equality Act 2010 made by the Worker Protection (Amendment of Equality Act 2010) Act 2023.

The consultation addresses the requirement for employer’s to take preventative measures to prevent sexual harassment at work.  Failure to take preventative measures may result in an uplift of up to 25% to any award made. Although liability for third party harassment was removed from the original proposal of reform of the law, the consultation makes clear that failure to take preventative measure may result in the EHCR taking enforcement action.
