Draft Regulations for changing collective consultation periods

The Government has today published draft Regulations which will reduce the minimum periods required for collective consultation.  Where it is proposed that 100 or more employees are to be dismissed in a 90-day period at any one establishment, the minimum period for collective consultation will reduce from 90 days to 45 days.  The Regulations, which also specify that the ending of a fixed term contract will be excluded from the collective consultation threshold unless the contract is ended by redundancy before the end of its term, will come into effect on 6 April 2013.
