Replacing striking staff with agency workers is unlawful

The High Court has ruled that it was unlawful for the Government to revoke legislation prohibiting striking workers to be replaced by agency workers, as the Secretary of State had failed to comply with the duty to consult before making the change.

Since July 2022, agencies have been permitted to supply agency workers to replace striking workers.
