Right to work checks

The Government has issued updated supporting guidance for employers on carrying out right to work checks. The guidance includes an update on conducting right to work checks for EEA citizens employed on or after 1 July 2021 and reiterates that there is no requirement for employers to carry out retrospective checks (although you may if you wish).

Looking ahead, the temporary changes to the right to work checks introduced because of coronavirus (COVID-19) in March last year will come to an end on 31 August 2021.  From 1 September 2021, employers must revert to carrying out checks face-to-face rather than being allowed to carry them out virtually on a video call, having seen a scanned copy of the original documents.
