The Right to a private life and disclosure of convictions

In R (on the application of T) v Secretary of State the Supreme Court has held that disclosure of a warning given to an eleven year old for stealing two bicycles, when later in life he applied for a part-time job with a football club entailing contact with children, violated his right to respect for private life under Article 8 of the ECHR.

The Supreme Court also held that disclosure of a caution given to a woman for shoplifting when 8 years later she applied for a job as a carer leading to her being refused the job was also a violation of Article 8.
