Consultation on proposed changes to TUPE and a response to the Ending the Employment Relationship consultation

The Government has today launched a consultation on proposed changes to the Transfer of Undertakings (Protection of Employment) Regulations 2006.   Amongst the proposals are:

  • the removal of service provision transfers from the scope of the regulations
  • changes to the employee liability information provisions
  • allowing microbusinesses to consult employees directly rather than through reps
  • changes to the rules on transfer-related dismissals and ETO reasons, and
  • provisions to allow TUPE consultation to also satisfy the requirement for collective consultation on redundancies.

The Government has also issued it's response to the Consultation on Ending the Employment relationship.  The response includes the introduction of a cap of twelve months' pay on the compensatory award for unfair dismissal.  The current limit of £72,300 will still apply if twelve months' pay is greater.  To read the response click here.
