Could your organisation rely on section 109(4) of the Equality Act 2010?

Under section 109(4) of the Equality Act 2010, there is a statutory defence available to employers who take reasonable steps to prevent acts of unlawful discrimination in their organisations.  Taking reasonable steps include providing equality and diversity training to the workforce.  Organisations that can demonstrate such training has been undertaken, on a regular basis, are in a strong position when it comes to defending claims of discrimination. Failure to provide evidence of regular equality and diversity training will of course have the opposite effect on the ability to defend a claim.
