Massive falls in employment tribunal claims

Statistics have been published today showing a 71 per cent drop in claims for the period April to June 2014 compared to the same period in 2013.

Further statistics  for the period April 2013 to March 2014 also show a huge drop in the number of claims from 191,541 (2012/13) to 105,803.

Fees for claims and hearings were introduced on 29 July 2013.  Unison will continue their challenge to the introduction of fees in the Court of Appeal, (it had been reported that the case would be heard on 18 September 2014 however we now understand this date is just to deal with ancilliary matters) and these figures suggest that they may have some success.  Only this week the shadow Business Secretary has said a Labour Government would repeal the whole employment tribunal system

 Costs awards

Whilst costs awards have increased in number the value of awards has declined.  In 2012/13 median costs and average cost awards were £1,842 and £3,141.  The figures for 2013/14 are £1,000 and £2,856.

 *Unfair dismissal is capped at the lower of £76,574 or one years’ salary.  For an award to exceed this cap the claim must have related to a case where the statutory cap does not apply.
